Welcome to BetterPaw LLC (“BetterPaw,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, products, services, and communications, including our QR-enabled dog tags and related notifications (the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase from or use our Services. By using our Services, you represent that you meet these requirements.

3. Account Registration

To purchase certain products or use certain features (including registering a QR dog tag), you may need to create an account. You are responsible for keeping your login credentials secure and for all activity under your account.

4. Orders, Pricing & Payment

All orders are subject to acceptance. Prices and availability are subject to change without notice. Payments are processed through third-party payment processors; you agree to their terms when using their services.

5. QR Dog Tag Service

When you register a QR-enabled dog tag:

  • You may enter pet details, images, and a public message.

  • You control what information is visible to anyone scanning the QR code.

  • Any information you choose to display publicly may be accessed by the public without restriction.

  • You may receive finder-submitted messages, including optional location data, which will be forwarded to you.

  • You are responsible for the accuracy of your profile data and for updating it as needed.

We are not responsible for the content of finder messages or for any third-party actions after contact is made through the QR service.

6. Public Profile Content Rules

You may not post any content that is illegal, defamatory, obscene, infringing, or otherwise violates applicable laws or the rights of others. We reserve the right to remove or modify public content at our discretion.

7. Finder Messaging

If you scan a QR tag and submit a message or location data to the pet’s owner, you agree not to misuse the service, submit false reports, or engage in harassment. Misuse may result in blocking or legal action.

8. SMS/Text Messaging (10DLC Compliance)

8.1 Purpose of SMS Messages

By providing your mobile number, you consent to receive:

  • Transactional messages related to QR tag activity (e.g., “Your pet’s tag has been scanned”), order updates, and account notifications.

  • Marketing messages (only if you have explicitly opted in), such as promotions or product updates.

8.2 Frequency

Message frequency varies based on your use of the Services, pet tag scan activity, and your marketing preferences.

8.3 Opting Out

You may opt out of marketing texts at any time by replying STOP to any message. You will continue to receive essential transactional alerts related to your QR tag unless you deactivate the tag.

8.5 Carrier & Cost Disclosure

  • Message and data rates may apply.

  • Mobile carriers are not liable for delayed or undelivered messages.

8.6 Your Responsibilities for 10DLC/TCPA Compliance

By providing your phone number, you confirm you are the subscriber or authorized user of that number and that you consent to receive messages. You agree not to provide a number that you do not have the right to use.

9. Intellectual Property

All content on our website, including text, graphics, logos, product images, and software, is owned by or licensed to BetterPaw and is protected by intellectual property laws. You may not use our intellectual property without our written permission.

10. Prohibited Uses

You may not:

  • Use the Services for unlawful purposes.

  • Attempt to access or interfere with our systems or data.

  • Misrepresent your identity or affiliation.

  • Post harmful or offensive content on public pet profiles.

11. Disclaimers

Our Services, including QR tag notifications, are provided “as is” without warranties of any kind. We cannot guarantee uninterrupted service or delivery of notifications, as these depend on third-party systems and networks.

12. Limitation of Liability

To the fullest extent permitted by law, BetterPaw will not be liable for any indirect, incidental, special, or consequential damages, including lost pets, arising from your use of the Services.

13. Indemnification

You agree to indemnify and hold harmless BetterPaw, its affiliates, and service providers from any claims arising out of your use of the Services, your public profile content, or your violation of these Terms.

14. Termination

We may suspend or terminate your access to the Services at our discretion, including for violations of these Terms or misuse of the QR tag system.

15. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.

16. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on our website with an updated “Last Updated” date. Your continued use of the Services after changes take effect constitutes your acceptance.
